The high Court has ordered Nation Media Group (NMG) to pay billionaire businessman and his wife Sh8 Million for the fake orbituary published in February.
In the obituary, the Nation Media Group claimed that businessman Jimmy Wanjigi was dead.
In a ruling delivered by Judge Wilfrida Okwany, the court stated that through the publication, NMG was found to have breached Jimmy Wanjigi’s privacy.
The court further dismissed NMG’s claim that it was a third party since the obituary was paid for by an unknown man.
According to the court’s ruling, NMG enjoyed the profits made from the obituary and hence awarded Wanjigi and his wife Sh8 million for having caused them pain and anguish.
“Nation owed a duty of care to make sure that it published accurate and fair information.They carried the obituary hence gained monetary benefit from it,” the judge ruled.
